What is HOPA?
The Housing for Older Persons Act of 1995 amends Title VIII of the Civil Rights Act of 1968 (Fair Housing Act).
The law makes it legal for communities to market themselves as 55 Plus (55+) which is Age-Restricted Status provided that 80% of occupied units have at least one person who is 55 years of age or older. Should the number fall below 80% the community will lose it Age-Restricted Status permanently.
Most 55 Plus (55+) communities have an age restriction stating that no one under the age of 18 can reside there. The actual age is different in different communities. However, most communities do allow people under the minimum age, such as grandchildren, to visit and stay for a pre-determined amount of time. That time limit (generally 2 weeks to 90 days) varies community by community.
